The Delaware Supreme Court, viewed by many as the nation’s top corporate court, has been rocked by turnover with four of its five justices retiring in roughly one year’s time. Corporate law analysts say the departures will not impact the state’s reputation among a business community more focused on the substance of law rather then the judges deciding it.

“I don’t think companies will leave Delaware unless we start to get odd rulings from the Supreme Court,” said Charles Elson, a professor of corporate governance at the University of Delaware. “Attorneys look at the people making the decisions closely, but companies do not. Only if we start to get atypical rulings or decisions that indicate a significant shift from the Delaware General Corporation Law will companies start to wonder about the justices.”
