The Delaware Supreme Court now has the opportunity to decide whether the state’s insurance commissioner will be able to sue auditors of insolvent insurance companies for breaches of fiduciary duty.
Vice Chancellor Donald F. Parsons Jr. agreed with the insurance commissioner that Parsons’ detailed decision examining whether there should be an “auditor exception” to the in pari delicto defense was so novel that it warranted interlocutory review.
