In the month since the U.S. Department of Justice sued to enjoin the proposed $34.6 billion merger between Halliburton and Baker Hughes, the giants in oilfield services have launched a campaign to have the case transferred from Delaware federal court to its “home” forum in the Southern District of Texas.

In its complaint filed April 6, the DOJ argued the U.S. District Court for the District of Delaware had subject-matter jurisdiction over the litigation under the 1914 Clayton Antitrust Act, and it maintained personal jurisdiction because both companies are Delaware corporations and are “inhabitants” of the state.
