A Delaware magistrate judge has  recommended that adeclaratory judgment action against AMI Entertainment Network proceed after the restaurant game-maker raised the possibility of infringement by a competitor.

U.S. Chief Magistrate Judge Mary Pat Thynge of the District of Delaware on Tuesday said AMI’s warnings last year about Tabletop Media’s pay-at-the-table Ziosk tablet had initiated a case that was subject to the noninfringement action.
