Video game developer Ubisoft appears poised to escape a patent infringement case after a Delaware federal magistrate judge on Nov. 4 recommended the dismissal of three remaining claims over the virtual reality technology underlying its popular “Just Dance” and “Rocksmith” games.

In a 26-page report, U.S. Magistrate Judge Christopher J. Burke of the District of Delaware said that plaintiff Princeton Digital Image Corp. had failed to lay out a plausible case that Ubisoft Entertainment SA and Ubisoft Inc. had indirectly infringed on its so-called ’129-patent before and after its suit was filed in U.S. District Court for the District of Delaware.
